Welcome to the Link2Build website. Link2Build Ontario (“Link2Build,” “we,” “us,” or “our”) is a partnership of seven Ontario construction associations, together with eSolutionsGroup Ltd. and bids&tenders. Our website provides daily construction news and bid opportunities across Ontario and serves as a place for parties to publish Certificates of Substantial Performance, Certificates of Completion of Subcontract, and other notices required under the Ontario Construction Act.

By using this website, you agree to these Terms of Use. If you do not agree with them, please do not use the website.

Public access and subscriptions

Anyone may visit the website to view general construction job and bid information at no charge. Access to documents and certain other materials — including the ability to view and download documents — requires a paid subscription. If you are a subscriber, you may use the documents you download for your own business purposes; please do not redistribute, resell, or republish them.

Documents and information come from outside sources

The documents, certificates, drawings, and other information on this website are prepared and supplied by outside parties such as architects, engineers, contractors, and other users. We publish these materials in the form we receive them. We do not write, edit, alter, or check them, and we do not verify or endorse their content.

You are responsible for reviewing and verifying the information

Because the materials on this website come from outside sources, you are responsible for reviewing and independently verifying the accuracy, completeness, and suitability of any document, certificate, or information before you rely on or act on it. We do not guarantee that any material is accurate, complete, current, or fit for your purposes, and you use it at your own risk.

Nothing on this website is legal or professional advice. In particular, publishing a certificate or notice through this website does not guarantee that you have met any requirement or deadline under the Construction Act or any other law. You are responsible for making sure anything you publish is accurate and legally sufficient, and you should not rely on this website alone to meet a legal obligation. If you are unsure, please seek independent legal or professional advice.

Posting documents and certificates

If you upload or publish a document or certificate, you confirm that you have the right to do so and that the information is accurate. You keep ownership of what you post; you simply give us permission to host, display, and publish it so the website can work as intended — including making documents available to subscribers and making certificates available for public viewing, as the Construction Act requires. You keep your own copy of any certificate you publish. You are responsible for the material you post, and we may remove anything we reasonably believe breaks these Terms of Use or the law.

Acceptable use

When using this website, please do not:

• share your access with others, or resell or redistribute access or content, except as allowed by your subscription;
• use the website to develop or run a competing service, or access it as a competitor of Link2Build without our written consent;
• post or transmit anything unlawful, infringing, defamatory, harassing, or obscene;
• attempt to copy, reverse engineer, or extract the website’s software or underlying data;
• try to gain unauthorized access to the website or other accounts or systems, or scan or test their security; or
• interfere with the website’s operation or introduce viruses or other harmful code.

Our website and trademarks

The website itself — its software, design, layout, the way content is organized, and the Link2Build name, logos, and branding — belongs to Link2Build (or its licensors). You may use the website as intended under these Terms of Use, but you may not copy, reproduce, or reuse these elements without our permission.

Privacy

We handle personal information in accordance with our Privacy Policy, available at www.link2build.ca/about/privacy-policy/. By using the website, you consent to the collection and use of your information as described there.

Links to other websites

The website may link to other websites or resources that we do not control. We are not responsible for the content, accuracy, or availability of those sites, and any dealings you have with them are between you and the operator of that site.

The website is provided “as is”

We work to keep the website useful and available, but we provide it on an “as is” and “as available” basis. We do not promise that it will always be accurate, error-free, secure, or uninterrupted, and we make no warranties of any kind, to the fullest extent permitted by law.

Limiting our liability

To the extent permitted by law, Link2Build is not liable for any indirect, incidental, special, or consequential losses — such as lost profits, lost business, or loss of goodwill — arising from your use of the website or your reliance on any material on it. Where we are found liable, our total liability to you is limited to the greater of $100 CAD or the subscription fees you paid us in the six (6) months before the event giving rise to the claim.

Suspending or ending access

We may suspend or disable an account or remove content if we reasonably believe these Terms of Use have been broken, and we may do so without prior notice. You may stop using the website at any time.

Changes to these Terms of Use

We may update these Terms of Use from time to time. When we do, we will post the updated version on the website and revise the date below. If you continue to use the website after we post changes, you accept the updated Terms of Use. If you do not agree with them, please stop using the website.

Governing law

These Terms of Use are governed by the laws of the Province of Ontario and the laws of Canada that apply there, and any dispute will be dealt with by the courts of Ontario.
